 Permission for Experimental Fishing 

With the authority in Article 23, Section 2 of Act No. 28 by the Faroese Parliament from the 10th of March, 1994 with later amendments and in conformity with signed agreement between the Fisheries Laboratory of the Faroe Islands and Faroe Seafood Prime P/F/Japanese vessel owner the Faroese Home Rule Government, Ministry of Fisheries has decided that the Japanese vessel :

is permitted to undertake experimental fishing for tuna in the Faroese Fishing Zone from The permission is conditional to that : 

  1. the experimental fishing can be carried out in all the Faroese Fishing Zone, except in areas on the Faroese continental shelf north of 61o N shallower than 400 m and on Faroe Bank shallower than 300 m (see area A and B on attached chart).
  2. the gear used in the fishing shall be pelagic longlining only,
  3. all fishing activity shall be in compliance with ICCAT regulations for tuna fishing applicable for Japanese vessels,
  4. the captain of the vessel shall keep a logbook in english language during the experimental fishing containing date, time, position, effort, catch etc. for each set of longline. This logbook shall be handed to the Fisheries Laboratory of the Faroe Islands by the end of the experiments,
  5. the vessel is prohibited to undertake experimental fishing unless observer(s) representing the Fisheries Laboratory of the Faroe Islands are onboard the vessel,
  6. the observers have the right unimpeded to observe all the fishing and processing activities, and to take whatever notes they want to retain to meet the objectives of the experimental fishing. In addition they shall have access to all holding rooms, wheelhouse etc. including the logbook,
  7. the observer(s) shall have opportunity to use the communication equipment on the vessel to report as required to relevant authorities and for liaising with other vessels in the area,
  8. embarking/disembarking of the observers shall be in compliance with the signed agreement between the Fisheries Laboratory of the Faroe Islands and Faroe Seafood Prime /the vessel owner,
  9. not less than three (3) persons will be Faroese crewmembers. One of the Faroese crew will be co-skipper and trained by the skipper and fishing-master of the vessel in the methods of catching etc. The other two will be trainees, and will be employed and trained in normal work on deck and in processing, and at least one of the Faroese trainees shall be given significant amount of training and work with the processing. The Faroese personel must be given appropriate conditions in all respects on board the vessel,
  10. when entering the Faroese Fishing Zone, the vessel shall inform the Inspection and Rescue Service the name of the vessel, the name of the captain, the registration number and radio call signal, the port registration letter and number, the size and length of the vessel, gross and net tonnage, propulsion power, the fish method used and any catch which it has prior to entry of the Faroese Fisheries Zone, specifying species and amount,
  11. that the vessel every forenoon reports to the Inspection and Rescue Service its position at 07:00 UTC that day and of the catch the previous day,
  12. that the vessel 12 hours before leaving the Faroese Fisheries Zone informs the Inspection and Rescue Service its position and at the same time gives an estimate of the size of the catch onboard, specifying species and amount,
  13. that the vessel complies with the instructions given by the Inspection and Rescue Service assisting the latter in the execution of its duties,
  14. that every effort shall be made to minimize harm on other fishing and the captain have to comply with the Inspection and Rescue Service and the observer(s) to avoid intrusion on other activity in the area,
  15. that information to the Inspection and Rescue Service are given over telex 81327, over Tˇrshavn Radio or to telefax + 298 31 39 81,
  16. vessels which have obtained a fishing license for fishing tuna are not permitted to carry out any other kind of fishing activity in the Faroese Fishing Zone,
  17. fishing gear, which is intended for other fishing activity than the fishing for tuna, must be kept separate in a special comparment designed for the stowing of such gear,
  18. when entering areas where fishing activity in conformity with this license not is permitted, all fishing gear must be stowed away in its normal place.

Breaches of the regulations in this license will be subjected in conformity with the Articles 40-48 of Act No. 28 by the Faroese Parliament from the 10th of March, 1994 with later amendments.

It is a prerequisite for this permission to become valid that the agreement between Faroe Seafood Prime/the vessel owner and the Fisheries Laboratory of the Faroe Islands has been duly signed of both parties.

Agreement between the Fisheries Laboratory of the Faroe Islands (FL) and " " Co. Ltd, Japan (SC) on experimental longlining fishing for tuna inside the Faroese EEZ.

  1. For the experiments SC will operate their vessel: " "and take all responsibility and pay all cost for vessel, gear, crew etc. including all cost that may arise from possible port call. The gear used will be pelagic longlining only. All fishing shall comply with ICCAT regulations.
  2. FL is entitled to put one scientific observer on the vessel. This observer shall have access to all holding rooms, wheelhouse etc. including logbook. The observer shall have opportunity to use the communication system on the vessel to report as required to relevant authorities and for liaising with other vessels in the area. When entering the Faroese EEZ the vessel in obliged to sail up to 100 nautical miles each way to embark observer from other vessel (or harbour) decides by FL. Before leaving Faroese EEZ the vessel is obliged to disembark the observer frequently (every second week), but this shall be done with minimal interruption to the fishing operation.
  3. The vessel are free to operate in all the Faroese EEZ, except in areas on the Faroese continental shelf, shallower than 400 m, and on the Faroe Bank shallower than 300 m (see area A and B on attaches chart.) However, on the Faroese continental shelf (area A) the vessel are allowed to operate south of 610 N. Every effort shall be made to minimise harm on other fishing and the captain has to comply with the observer, to avoid intrusion on other activity in the area.
  4. The experimental fishing can be conducted in the period from July 1st 1998 to December 1st 1998. Entrance to the Faroese EEZ shall be noted to FL 7 days prior.
  5. The captain of the vessel is obliged to keep a logbook during the experiments containing date, time, place, catch etc. for each set of longline. This logbook shall be handed to FL by the end of the experiments.
  6. All catch is the property of SC. If the bycatch of others than tuna is more than 10% in weight, FL/observer can stop the fishery in certain areas and demand the fishing operation elsewhere.
  7. To cover expenses, including payment to observers, SC will pay to FL, before the start of the experiments 9.900 USD for the period of 30 days.
